Terms of Service

These Terms of Service govern your use of SubFT. Please read them carefully before creating an account, purchasing credits, or starting AI-powered processing.

Acceptance of Terms

By using SubFT or creating an account, you agree to these Terms of Service. If you are using SubFT on behalf of a business, you confirm that you are authorized to act on behalf of that business.

Description of Service

SubFT is a platform for subtitle workflows, including transcription, OCR recognition, translation, editing, and export of subtitles. AI processing is only initiated when you trigger corresponding jobs.

We may develop, modify, or discontinue features as required for operations, security, product development, or legal requirements.

User Obligations

You are responsible for ensuring that you hold all necessary rights to uploaded files, subtitles, and other content. You must not use SubFT for illegal content, rights infringements, bypassing technical protection measures, abuse, spam, security attacks, or overloading the infrastructure.

Credits and Billing

Credits are purchased in advance and credited to your account. They are deducted when machine processing starts or completes, depending on the billing logic displayed in the product.

If a planned job is canceled before processing begins, or if an internal error is detected, credits may be automatically or manually credited back to your account.

Refunds and Withdrawal

Payments and statutory withdrawal or refund requests are handled via Paddle in accordance with Paddle's terms and applicable law. Your mandatory consumer rights remain unaffected.

There is no general voluntary right to a refund for purchased credits. If a payment is refunded, unused credits may be removed or offset from your SubFT account. Credits that have already been consumed for started processing are not voluntarily refundable unless required by law or if SubFT confirms a material technical failure of the service.

Content and Intellectual Property

You retain your rights to the content you upload and the subtitle outputs generated for you. You grant SubFT the rights necessary to store, process, transmit, and provide features to you.

SubFT, the software, user interfaces, trademarks, and platform components remain the property of SubFT or the respective right holders.

Availability and Changes

We endeavor to ensure reliable operation, but do not guarantee uninterrupted availability. Maintenance, security measures, service provider outages, or technical disruptions may temporarily restrict use.

Liability

We are liable without limitation in cases of intent, gross negligence, injury to life, limb, or health, and under mandatory statutory provisions.

Otherwise, we are only liable in accordance with applicable law. For slight negligence, we are only liable for the breach of material contractual obligations and limited to foreseeable damages typical for this type of contract.

Governing Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country where you have your habitual residence remain unaffected.
